مروری بر حقوق کودکان دارای ناتوانی و معلولیت |

برآوردها حاکی از ابتلای حدود 10 درصد از جمعیت جهان به نوعی از معلولیت و ناتوانی است که در میان آنان 150 میلیون کودک زیر 15 سال وجود دارند. علاوه بر مشکلات اجتماعی، اقتصادی، فرهنگی و ... که این افراد و خانواده‌های آنان دارند، هزینه‌های سنگینی نیز برای امور مختلف آنان از جمله بهداشت، درمان و توانبخشی، آموزش و اشتغال، مسکن و سایر نیازها باید پرداخت شود. موضوع حقوق کودکان داران ناتوانی و معلولیت از جمله چالشهای مهم و مورد توجه در سالهای اخیر بوده است. بررسیها حاکی از اختصاص تنها یک ماده از «پیمان‌نامه جهانی حقوق کودک» در این زمینه است. تلاشها برای تدوین موادی برای تأمین حقوق کودکان از 1924 آغاز گردیده است. مهم‌ترین اقدامات انجام شده تصویب اعلامیه حقوق کودک در سال 1924 و تصویب «پیمان‌نامه جهانی حقوق کودک» در 1989 برای کلیه کودکان جهان بوده است. برای کودکان معلول هرچند مواردی که به صراحت تمام نام‌برده شده باشد موجود نیست، لیکن اعلامیه «حقوق عقب‌ماندگان ذهنی» در سال 1971 و اعلامیه «حقوق معلولین» در سال 1975 و نیز ماده 23 «پیمان‌نامه حقوق کودک» از جمله موارد مهمی است که به این موضوع پرداخته است. مصوبه »قوانین استاندارد برای معلولان» در سال 1993 نیز راهکار مناسبی برای پرداختن به‌موضوع حقوق کودکان معلول می‌باشد. تلاشها در سالهای اخیر برای تصویب «پیمان‌نامه جهانی حقوق معلولان» که می‌تواند ضمانت اجرایی مناسبی از سوی دولتها داشته باشد ادامه دارد. |

On the basis of estimates, about 10 percent of people all around the world are facing a sort of physical or mental disability, among which there are 150 million children under the age of 15. Besides civil, social, economic, cultural and many other difficulties for- disabled children and their families, a huge investment is also needed to obtain their many kinds of necessities that affect their lives, such as health care, rehabilitation, education, and employment. In the recent years, the issue of “Right of Disabled children“ have started into a noticeable challenge worldwide. According to the facts, however, only one article of “The convention on the Rights of the children" has allocated for disability subject. The attempts in drafting actions for obtaining “rights for children“ have started since 1926. The most accomplished effort fruited in adaption of the Declaration of Human Rights for children (1924), as well as “the convention on the rights of the child“ (1989) for all children everywhere. Although disabled children issues are not explicity stated in any of principles. Declaration of mental retardation (1971) and. Declaration of disabled person (1975), as well as article 23 of convention on children rights , are included as the most effective subjects relating to the protection of disabled children. It is also feasible to engage in disability issue under the light of convention of the rights of disabled. |
